ToniArts software license agreement

1. END USER LICENSE AGREEMENT (EULA) 

All ToniArts software and accompanying written materials are provided "as is" without warranty of any kind. Further, the author does not warrant, guarantee, or take any representations regarding the use, or the results of use, of the software or written materials in terms of correctness, accuracy, reliability, currentness or otherwise. The entire risk as to the results and performance of the software is assumed by you. 

Neither ToniArts nor anyone else who has been involved in the creation, production or delivery of our products (directly or indirectly) shall be liable for any direct, indirect, consequential, accidental or incidental damages (including damages for loss of business profits, business interruption, loss of business information and the like) arising out of the use or inability to use the product even if the author has been advised of the possibility of such damages. 

Any kind of reverse engineering of the software is not allowed.

By using our software, you acknowledge that you have read, understand, and agree, to be bound by the terms as set out in this license agreement. Any exception in following this license agreement needs a written permission from ToniArts.

2. DISTRIBUTION

You are free to distribute any of our software titled as "FREEWARE" as you see fit as long as the following is agreed to prior to your doing so. 

1. All files remain unchanged and intact
2. No attempt is made to sell or otherwise personally gain, from the distribution of our software 

You may not list any of our programs either on website that charge for access to listings, or charge to download programs. You may also not list or distribute our software via CD-ROM or any other media, unless your charges are for postage only.  

If including our application on media such as CD-ROM, DVD, floppy diskette, ToniArts must be informed prior to your doing so. Additionally, ToniArts reserves the right to request and be sent, a copy of such media without charge.

3. PRIVACY

ToniArts software may contain online functionality such as software update feature. ToniArts assures you that no personal information is collected with any online function, unless asked for your permission first.
